1. Acceptance of Terms

By accessing our website at essencespaandesthetics.com or booking an appointment with Essence Spa and Esthetics, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Essence Spa and Esthetics provides professional esthetics services including facials, skin care treatments, dermaplaning, and related services performed by Deanna Cervantes, a licensed esthetician in the State of Indiana. Services are performed at our location in LaPorte, Indiana.

We reserve the right to refuse service to anyone at our sole discretion, including but not limited to situations where a client's health condition may be contraindicated for a particular treatment.

3. Booking and Appointments

Appointments may be booked online through our website. To secure your appointment, a valid credit or debit card must be placed on file. No deposit is charged at the time of booking. Your card will only be charged after your appointment is completed.

Appointment times are subject to availability. We will make every effort to honor your scheduled time; however, we reserve the right to reschedule appointments in the event of an emergency or unforeseen circumstances.

4. Cancellation and No-Show Policy

Cancellations made less than 12 hours before the scheduled appointment time, or failure to appear for a scheduled appointment (no-show), will result in a cancellation fee equal to 50% of the booked service price. This fee does not include any tip and will be charged to the card on file.

We understand that emergencies happen. If you have an extenuating circumstance, please contact us as soon as possible at 219-575-5909 or [email protected] and we will do our best to accommodate you.

5. Payment

Payment is processed securely through Stripe. By providing your payment information, you authorize Essence Spa and Esthetics to charge the card on file for services rendered and any applicable cancellation fees as described in Section 4.

Gratuity (tip) is entirely optional and at the client's discretion. Tips will only be charged if voluntarily selected by the client at the time of booking confirmation. Tips are never included in cancellation fees.

All prices are listed in U.S. dollars. Prices are subject to change without notice, though any changes will not affect appointments already booked at the original price.

6. Gift Cards

Gift cards purchased from Essence Spa and Esthetics are valid for five (5) years from the date of purchase, in compliance with the federal Credit Card Accountability Responsibility and Disclosure (CARD) Act and Indiana state law. Gift cards have no cash value and are non-refundable. Lost or stolen gift cards cannot be replaced. Gift cards may be applied toward the cost of services but cannot be used to pay cancellation fees.

7. Age Requirements and Minors

Clients under the age of 18 are welcome to receive esthetics services at Essence Spa and Esthetics; however, a parent or legal guardian must provide written consent prior to the appointment. The parent or guardian must be present during the service for clients under the age of 16. By booking an appointment for a minor, the parent or guardian agrees to these Terms of Service on the minor's behalf and assumes full responsibility for the appointment, including any applicable fees.

8. Health and Safety

You are responsible for disclosing any known allergies, skin conditions, medications, or health conditions that may affect your treatment. Essence Spa and Esthetics is not liable for adverse reactions resulting from undisclosed health information. We reserve the right to decline or modify a service if we determine it may pose a health risk to the client.

If you are feeling unwell on the day of your appointment, we ask that you reschedule out of respect for the health and safety of our staff and other clients.

9. Refunds

All services are non-refundable once rendered. If you are unsatisfied with your service, please contact us within 48 hours of your appointment and we will work with you to address your concerns. Gift cards are non-refundable.

10. Intellectual Property

All content on this website, including text, images, logos, and graphics, is the property of Essence Spa and Esthetics and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any content from this website without our prior written permission.

11. Limitation of Liability

To the fullest extent permitted by law, Essence Spa and Esthetics shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the service in question.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in LaPorte County, Indiana.

13. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be effective upon posting to our website with a revised effective date. Your continued use of our services after any changes constitutes your acceptance of the updated terms.
